1. Introduction
ARC9 Labs (“ARC9,” “we,” “our,” or “us”) is an institutional advisory and applied intelligence group operating under license from Forlytica Applied, the commercial arm of the Forlytica Research Group.
This website (“Site”) provides descriptive information regarding ARC9’s advisory approach, institutional engagement model, and analytical perspectives on collegiate athletics and related economic systems.
These Terms of Use (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms.
2. Purpose and Use of the Site
a) Scope
The Site provides high-level descriptions of ARC9’s advisory frameworks, analytical approach, and engagement structure. It does not disclose proprietary models, internal methodologies, datasets, or research mechanics.
b) Eligibility
You may use the Site only if you are legally capable of entering into a binding agreement in your jurisdiction.

Reference the Site for informational purposes
Inquire about institutional advisory engagements
All use must comply with these Terms and applicable law.
d) Prohibited Conduct
You may not:
Reverse engineer, infer, or attempt to extract proprietary systems or methodologies
Misrepresent ARC9 Labs’ role, findings, or capabilities
Use Site materials for deceptive, unlawful, or competitive misuse
Interfere with Site operation, security, or availability
e) No Rights Conferred
Access to the Site does not grant any license or rights to ARC9 Labs’ or Forlytica’s proprietary frameworks, systems, data, or intellectual property unless expressly granted in writing.
3. Institutional Engagements
All advisory work is conducted solely pursuant to a separate written agreement defining scope, deliverables, intellectual property, confidentiality, and commercial terms.
Nothing on the Site constitutes an offer, proposal, or commitment to provide services.
4. Intellectual Property
a) Ownership
All Site content—including text, graphics, layout, trademarks, logos, and visual systems—is owned by or licensed to ARC9 Labs or its affiliates and is protected by applicable intellectual property laws.
b) Limited Reference Use
Public content may be referenced with proper attribution. Reproduction, redistribution, modification, or commercial use requires prior written permission.
c) Trademarks & Identity
“ARC9 Labs,” “Forlytica,” and associated marks and visual elements may not be used without authorization.
5. Submissions and Communications
Unsolicited submissions are non-confidential unless otherwise agreed in writing. Submission does not create any obligation, compensation right, or ownership interest.
All communications must be lawful, accurate, and non-disruptive.
6. Disclaimers
a) Informational Nature
Materials on the Site are descriptive of advisory frameworks and engagement models and do not constitute investment, legal, accounting, regulatory, or professional advice.
b) No Warranty
The Site and its content are provided “as is,” without warranties of accuracy, completeness, fitness for a particular purpose, or uninterrupted availability.
7. Non-Reliance and Limitation of Liability
Use of the Site does not create any advisory, fiduciary, client, or professional relationship.
To the maximum extent permitted by law, ARC9 Labs disclaims liability for indirect, incidental, consequential, or punitive damages arising from Site use. If liability cannot be disclaimed, it is limited to USD $100.

You represent that you are not subject to applicable trade restrictions and will not use the Site for prohibited purposes.

12. Governing Law and Miscellaneous
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Exclusive venue lies in Utah County, Utah.
If any provision is held unenforceable, the remainder remains in effect.
These Terms constitute the entire agreement regarding Site use.
13. Relationship to Forlytica Research Group
ARC9 Labs operates under license from Forlytica Applied and applies select outputs derived from research conducted by the Forlytica Research Group.
Nothing in these Terms grants access to or rights in such underlying research or associated systems.
14. Revisions
We may update these Terms from time to time. Continued use of the Site constitutes acceptance of the revised Terms.
